In the past forty years, the “war on drugs” and the use of criminal law to wage that battle have contributed to a significant increase in the prison population in many countries around the world, particularly in Latin America.
This paper aims to contribute to the discussion of the advisability of adopting drug courts. In particular, it analyses the true scope of the model, recognising its limitations and obstacles to its implementation.
